University Rule 3-160: Competition with Private Enterprise

  1. Purpose
    1. To conform to Board of Regents Rule R555
  2. Definitions
    1. Definitions are provided in the Policy
      1. Campus Community shall mean prospective students, students, faculty, staff, alumni, and campus guests of the University of Utah.
      2. Institutional Services shall mean the University's facilities, goods and services.
      3. Educationally Related Services shall mean those non-academic services that are reasonably related to the educational needs of the campus community, e.g., campus newspaper, campus store(s), campus dining facilities, student-housing, printing services, etc.
      4. Non-academic self-support Services shall mean services that are complementary to an institution's teaching, research, and public service functions and are funded through the service's own activities or by charging a fee directly related to the costs of providing the goods or services.
  3. Rule
    1. Educationally Related Services
    2. The University and its units may provide Educationally Related Services to the Campus Community so long as such services are provided in accordance with the requirements of Board of Regents Rule R555.
    3. Services to Persons Other than Members of the Campus Community
    4. The University and its units must comply with the requirements of Board of Regents Rule R555 before providing Institutional Services to any person who is not a member of the Campus Community.
    5. Grievances
    6. Any privately owned business that believes the University is competing with the private business in violation of Board of Regents Rule R555 may file a grievance according to the procedures set for in Procedure P3-008 accompanying this Rule.
